Personal Injury Practice Areas

Prime Law Firm regularly handles a wide array of personal injury claims arising from:

  • Automobile Accidents — New York is a No-Fault state for insurance purposes, which means that an injured party is required to seek compensation for certain injuries and damages from his or her own insurance company, regardless of who is at fault. In accident cases involving a “serious injury,” however, it may be possible to bring a personal injury lawsuit against the other driver. We leverage our skills and resources to obtain favorable settlements or jury verdicts for our clients.
  • Construction Accidents — With plenty of residential and commercial building underway in the greater New York area, construction accidents are on the rise. Workers can be injured by falls, cave-ins, fires and explosions, falling objects, defective equipment, and many other hazards. While construction workers are generally covered under Workers' Compensation Insurance, a personal injury claim can arise over safety violations or be brought against negligent third parties.
  • Truck Accidents — Motor vehicle drivers have little choice but to share the roads and highways with trucks and tractor-trailers. Given the size and weight of a typical commercial truck, a collision can lead to catastrophic injuries and fatalities to occupants of smaller vehicles. Our firm is dedicated to holding negligent trucking companies and truck drivers accountable for personal injuries and wrongful deaths.
  • Medical Malpractice – People in need of medical care place their trust and wellbeing in the hands of doctors and other medical professionals. When patients are injured because of a doctor's failure to provide the appropriate standard of care, victims and their loved ones can recover damages through a medical malpractice lawsuit.
  • Pedestrian Accidents — Busy New Yorkers are frequently struck by cars, city buses, taxicabs and other vehicles. Although pedestrians are required to abide by all traffic laws and exercise reasonable care for their own safety, all drivers have a duty of care not to injure others while operating a motor vehicle. We routinely pursue personal injury lawsuits arising from pedestrian accidents.
  • Slip, Trip and Fall Accidents — Owners of private, commercial and public property in New York City have a duty to maintain their property and provide visitors and passersby with a safe environment. When slippery surfaces, broken steps, raised sidewalks, poor lighting or other hazards cause or contribute to accidents and injuries, our team can pursue a premises liability lawsuit against the negligent party.
  • Ridesharing Accidents — As ridesharing services such as Uber and Lyft become more and more popular, personal injury claims are also becoming more common. While New York's No-Fault insurance law applies to Uber and Lyft Accidents, determining liability poses unique challenges, which makes having proper legal representation crucial.
  • Product Liability — Businesses have a duty to ensure that the products they provide to the public are safe. If a consumer is injured by a dangerous or defective product or one that did not contain adequate warnings of the associated dangers, a product liability lawsuit can be brought against a negligent manufacturer or retailer.
  • Wrongful Death — Losing a loved one is an overwhelming experience, which can even more difficult when the death was caused by the reckless, negligent or malicious conduct of another. Although no amount of money can ever replace a life, surviving family members can obtain justice through a wrongful death lawsuit. Workplace Accidents — Injuries occur in many workplaces — retail stores, restaurants, office buildings, utility plants, and factories. While most workplace accidents are covered under workers' compensation, third party claims are not uncommon.

Our experienced personal injury attorneys have a well-deserved reputation for designing innovative legal strategies and helping our clients obtain just compensation.

How long do I have to file a personal injury claim in New York?

Under state law, there is a time limit for filing a personal injury claim, referred to as the statute of limitations, that depends on the nature of the claim. Generally, the limit for a negligence claim involving an injury is three years from the date of the accident or injury. For a medical malpractice claim, however, the period is shorter — two and one-half years from the date of the alleged malpractice. Finally, there is a two year statute of limitations for wrongful death claims. In any event, the sooner you speak to an experienced personal injury attorney, the better your chances will be of recovering damages.

How much is my personal injury claim worth?

It is important to remember that each case is unique, and the amount of money you may be awarded depends on a number of factors. Generally, however, you may be entitled to economic and noneconomic damages:

  1. Economic damages — Compensate injury victims for lost wages, past and future medical expenses, property damage, and similar financial losses
  2. Noneconomic damages — Covers pain and suffering, physical disabilities, disfigurement, loss of limbs, and loss of enjoyment of life.

If the at-fault party's conduct was reckless or malicious, such as driving under the influence or another criminal violation, it may also be possible to recover punitive damages, regardless of whether or not the other party is convicted. Such damages are aimed at punishing the other party's misconduct as well as deterring others from engaging in similar behavior.
